Burger King is facing a new lawsuit against them that is claiming their Whoppers are too small. The lawsuit was filed in a Manhattan federal court, alleging that there is a “vast discrepancy” between the advertised picture on Burger King’s menu and the actual size of the hamburgers served.
The plaintiff in the suit, Alexandra Profziskin, claims that she ordered two Whopper hamburgers from a Burger King in Times Square with an expectation of them being a certain size based off the menu photo. However, upon receiving her order, Profziskin alleges that the hamburgers were roughly half the size of the advertised pictures.
The lawsuit’s allegations state that Burger King’s false advertising and presentation misled customers into believing that Whoppers came in a much larger size than what was actually given. This, the suit claims, has “unjustly enriched” Burger King and “injured consumers” who believed they were paying for the advertised product.
Should the lawsuit be successful, it would be ordered that Burger King pay compensatory and punitive damages due to the discrepancy. It has not been made clear as to why Burger King is allegedly serving hamburgers much smaller than depicted on their menu, though there have been many other suits brought up against Burger King in regards to misleading and false advertisement.
The fast-food restaurant has not commented on the suit as of yet, but they are expected to make a statement soon. With similar cases like this popping up all over the country, it appears that Burger King may have to face adjustment in the way they conduct business in the future.
