Another Life Lost: The Fight for Heatstroke Safety in Texas

As temperatures Mary across Texas, delivery drivers are forced to operate and work their vehicles in extreme heat, refusing to take a break due to the pressure of tight schedules and tight deadlines. Unfortunately, the dangerous conditions have claimed the lives of yet another delivery driver—a grim reminder that companies and workers need to be proactive in protecting themselves from the extreme heat.

On the evening of July 21, 2019, a Taco Bell delivery driver in Austin, Texas collapsed in the middle of his shift due to the heat. Despite his coworkers’ efforts to get him to the hospital in time, the driver passed away at the scene.

The tragedy has sparked debates over workplace heat safety, with critics of the current system arguing that many employers fail to provide proper protection or compensation for those who are forced to work under harsh conditions. Texas is one of the few states that does not impose strict regulations to protect workers from extreme conditions, even though more than 40 percent of all Occupational Safety and Health Administration (OSHA) heat-related fatality investigations in 2019 took place in the state.

The Texas Department of Transportation has recently released new guidance on heat safety for commercial vehicle drivers, which includes hydration advice, a reminder of the dangers of the sun, and a reminder to take frequent breaks. Although it’s a step in the right direction, it is not enough to ensure safe working conditions, as the current regulations do not provide guidance on how to adjust driving practices or compensate employees for the risk of working in high heat.

As the Texas heat continues to take its toll, it’s important to remember that delivery drivers are not the only ones at risk. Numerous industries have to take into account the strength of the heat and adjust safety measures accordingly in order to protect their workers. Companies must pay attention to the conditions under which their employees are working and do their best to protect them from the extreme heat. This is the only way to prevent further tragedies such as the death of the Taco Bell delivery driver.
